Rules of Use | PJCCI

These Rules of Use form a legal contract between any person (hereinafter the “User”) using the platforms and sites of JCCBI (hereinafter the “Digital Space”) and The Jacques Cartier and Champlain Bridges Incorporated (JCCBI) regarding the use of any material under the responsibility of JCCBI.

By using JCCBI’s Digital Space, the User agrees to be bound by the terms and conditions of this contract for as long as he is on this Digital Space and if he has signed up for a service offered by JCCBI.

A User who does not wish to be bound by this contract must not use this Digital Space. The contract terms and conditions may be modified at any time and shall take effect automatically. No notice shall be issued following a change to the rules of use; it is the User’s responsibility to check whether the rules of use have been modified.

JCCBI sets guidelines for discussions indicating to the User the type of content accepted on its platforms to ensure that conversations take place in a friendly environment that is acceptable for all. For this purpose, JCCBI suggests that you consult its Netiquette.

INTELLECTUAL PROPERTY

The User acknowledges and agrees that any and all content and material available on this Digital Space – including, but not limited to, texts, applications, databases, photos, videos, presentations and logos – are the property of JCCBI and are protected by intellectual property legislation, including the Copyright Act, the Trade-marks Act and the Patent Act. Any content and material made available on the Digital Space are either exclusively owned and controlled by JCCBI or used under licence.

USE OF THE DIGITAL SPACE

The User is not authorized to use this Digital Space for illegal purposes, such as publication, distribution or circulation of any illegal material or information, in particular:

  • any content failing to comply with the principles set forth in the Canadian Charter of Rights and Freedoms;
  • any defamatory, obscene, racist or hate-mongering content;
  • any content intended to harass a third party or violate its privacy;
  • any content encouraging crime, suicide, discrimination or violence;
  • any content likely to cause harm to users who have not reached the age of majority or prejudice human dignity;
  • any content belonging to a third party, in particular trademarks and copyrighted data.

In addition, the User may not use this Digital Space to collect other users’ personal information.

WARRANTY DISCLAIMER

This Digital Space may contain technical inaccuracies or typographical errors. JCCBI reserves the right to modify or remove any information or content without prior notice. JCCBI, its employees and agents, and Her Majesty in Right of Canada do not warrant the accuracy of the information contained in the Digital Space and take no responsibility for it. The User assumes all risks associated with the use of the Digital Space.

The content and material provided on this Digital Space are provided without any warranty, whether express or implied. Any notice or information provided by JCCBI shall in no way constitute a warranty. JCCBI, its employees and agents, and Her Majesty in Right of Canada shall not warrant the accuracy, reliability and accuracy of the content and material made available on the Digital Space, or the availability of the site at any time or place, or that the content, information, software or any material that can be accessed from this Digital Space is free from viruses or other harmful components.

WAIVER OF LIABILITY

JCCBI, its employees and agents, and Her Majesty in Right of Canada shall not be held liable for any direct or indirect damages, including, but not limited to, any loss and/or expense that results from the use or inability to use the website or the content and material to which the website gives access.

The User waives all claims or legal action he may have against JCCBI, its employees and agents, and Her Majesty in Right of Canada for any damage of any kind whatsoever, resulting directly or indirectly from the use of the Digital Space.

This waiver of liability applies to contractual or extra-contractual damages, even if JCCBI knew of or could not ignore such damages.

INDEMNIFICATION

The User agrees to indemnify and hold harmless JCCBI, its employees and agents, and Her Majesty in Right of Canada for and against all losses, damages, prosecution, claims, proceedings, costs, requests, fees and expenses resulting from his use or misuse of this Digital Space. The User agrees to offer all necessary assistance to JCCBI, its employees and agents, and Her Majesty in Right of Canada in any lawsuit or claim that may arise in connection with the use of the Digital Space.

THIRD PARTY WEBSITES

Any reference to products, services, processes, hypertext links from third parties or other information by citing a trade name, trademark, manufacturer, supplier or other shall not constitute or imply approval, endorsement or recommendation by JCCBI, its employees and agents, and Her Majesty in Right of Canada. In addition, the Digital Space may link the User to other websites that are not under the control of JCCBI. JCCBI denies any responsibility for the accuracy of information and compliance with copyright, legality or any other aspect of third party websites.

PRIVACY POLICY

JCCBI is bound by the Access to Information Act and the Privacy Act. As a rule, the User does not have to disclose personal information to consult this Digital Space. However, the User may have to disclose his identity to access certain services.

JCCBI collects two types of information about users. The first type is personal information that the User discloses on a voluntary basis, such as name, address, telephone number, e-mail address, etc., when using a service provided by JCCBI. JCCBI may keep personal information that has been disclosed on a voluntary basis in order to identify the User in future communications and personalize the service rendered.

In addition, JCCBI collects analytical data concerning its Digital Space (number of visitors and subscribers, pages visited, time spent reading, content shared, etc.) in order to improve our information services.

Cookies

JCCBI may store cookies on the User’s hard drive to gather non-personal information. Cookies are files that the web browser places on the hard drive during a visit to the Digital Space. Browsers can be configured to automatically accept cookies or not. Among other things, cookies personalize browsing and ensure recognition during future visits.

Transmission of data to third parties

JCCBI undertakes not to disclose information collected from its Digital Space to third parties without the User’s prior consent, except in cases where it is required by the applicable laws or the information is disclosed during data collection.

Data security

JCCBI covenants to keep secure all data collected and to take the appropriate measures to protect personal information against loss, fraud and unwanted use.

GRANT OF LIMITED LICENCE TO JCCBI BY THE USER

By posting, submitting or transmitting any content in the Digital Space, the User authorizes JCCBI, its employees and agents, and Her Majesty in Right of Canada to use, reproduce, display, execute, adapt, modify, distribute, have distributed and promote the content in any form or place whatsoever and for any purpose whatsoever, whether commercial or otherwise, without any restriction or expectation of compensation, except where provided by law.

The User hereby waives the exercise of any and all remedies in connection with the rights which he may claim with respect to the use by JCCBI of the content added by the User to the Digital Space, including intellectual property rights.

The User represents and warrants that he owns or controls all rights related to his personal content and that the public release and the use of his content by JCCBI shall not affect or infringe the rights of a third party.

CONSENT OF THE USER TO VERIFICATION AND DISCLOSURE

JCCBI shall have no obligation to verify the information on its Digital Space or transmitted to it. However, anyone using this Digital Space agrees that JCCBI shall periodically verify the content thereof (1) to comply with any law, regulation or request from the authorities; (2) to properly operate its Digital Space or to protect itself and its users; or (3) for any other reason, in the sole discretion of JCCBI.

JCCBI, in its sole discretion, reserves the right to modify, reject or delete any information on its Digital Space or transmitted to it if JCCBI considers that such information is unacceptable or in violation of these Rules of Use or of its Netiquette.

Except where provided by law, if the User of this Digital Space shall provide information, including, but not limited to, data, answers, questions, comments, suggestions, projects, ideas, etc., such information may be used by JCCBI in its discretion, and the User shall waive the confidentiality thereof.

CLAIM PROCEDURE FOR INFRINGEMENT

If a User believes that his content or work has been copied and that it is made available on this Digital Space in a manner constituting an infringement or in violation of intellectual property legislation, you can contact JCCBI by completing the contact form at Contact us.

JURISDICTION

These Rules of Use shall be governed and construed in accordance with the laws of the Province of Quebec. In the event of a dispute or difference regarding any of the undertakings, conditions and provisions hereof or on a point of legal interpretation which cannot be settled by agreement between the parties, the Civil Code of Québec and the laws of Canada in force in the Province of Quebec shall apply, and the dispute may be resolved by a Court having jurisdiction in the Province of Quebec, in the judicial district of Montreal.

SEVERABILITY AND ENTIRE AGREEMENT

Unless otherwise specified herein, this Agreement constitutes the entire agreement entered into between the User and JCCBI with respect to the Digital Space, and supersedes all prior or contemporaneous communications and proposals (whether oral, written or electronic) relating to this Digital Space between the User and JCCBI. If any portion of these Terms of Use is deemed invalid or unenforceable, the remaining conditions hereof shall remain in full force and effect.

TERMINATION

JCCBI reserves the right, in its sole discretion, to terminate the User’s access to all or part of the Digital Space, with or without prior notice.

EXPORT

The User undertakes to never export to any destination whatsoever any part of the content or material provided, or any product obtained directly through such content or material, except if in compliance with the prevailing laws, rules and regulations in the area of export.

The use of any related documents and graphics and of any other material provided on this Digital Space is subject to the above Terms of Use.

Trademarks

The name JCCBI, its logo and all product and service names, as well as design marks and slogans related to it are trademarks, service marks or registered trademarks of JCCBI, and cannot be used for commercial purposes without the prior written consent of JCCBI. All other product or service marks on this Digital Space shall be registered trademarks that belong to their respective owners.
